The definition of what constitutes ‘sham contracting’ has changed under recent industrial relations (IR) legislative reforms. This change also coincides with greater civil penalties for breaches of the Fair Work Act provisions relating to independent contractor arrangements, both made ahead of changes to the definition of employment.
